(hereinafter “Convertia”) provides the services "as is" and "as available," without any warranty, representation, or statement, whether express, implied, or statutory. To the maximum extent permitted by applicable law, Convertia expressly disclaims any implied warranties of title, merchantability, fitness for a particular purpose, and/or non-infringement. Convertia makes no representation or warranty that access to the website, any part of the services, or any materials contained therein will be continuous, uninterrupted, timely, or error-free.
Convertia is not responsible for any interruption or loss that a user may suffer. You hereby acknowledge and agree that you have not relied on any other statement or understanding, whether written or verbal, regarding your use and access to the services and the website.
Without limiting the foregoing, you acknowledge and agree to the various risks inherent in the use of digital currency, including, but not limited to, hardware failures, software issues, internet connection failures, malicious software, third-party interference leading to loss or lack of access to your account or wallet and other user data, server failure, or data loss.
You agree and acknowledge that Convertia will not be responsible for any communication failures, interruptions, errors, distortions, or delays you may experience while using the services, however caused.
Under no circumstances will Convertia, its affiliates and service providers, or any of their respective directors, officers, agents, employees, advisors, consultants, or representatives be liable: (a) for an amount greater than the total fees paid by you for the service that is the subject of the cause of action in the twelve (12) months preceding the loss arising; or (b) for any loss of profits, diminution in value or business opportunity, any loss, damage, corruption or breach of data or other intangible property, or any special, incidental, indirect, intangible or consequential damages, whether based in contract, tort, negligence, strict liability, or otherwise, arising out of or in connection with the authorized or unauthorized use of the site or the services, or this agreement, even if an authorized representative of Convertia has been advised or knew or should have known of the possibility of such damages, and notwithstanding the failure of any agreed or other remedy of its essential purpose, except to the extent of a final judicial determination that such damages were the result of gross negligence, fraud, willful misconduct, or intentional violation of the law.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
We do not control or own the underlying software protocols that govern the operation of Digital Assets. These protocols are typically open source, allowing anyone to use, copy, modify, and distribute them. We do not assume any responsibility for the operation of these underlying protocols, nor can we guarantee the functionality or security of network operations.
Specifically, these protocols may be subject to sudden changes in their operating rules, including "forks." Such operational changes can significantly affect the availability, value, functionality, and/or name of the corresponding digital currency. Convertia has no control over the timing or characteristics of these significant operational changes.
It is your responsibility to stay informed about upcoming operational changes and carefully consider the publicly available information and that provided by Convertia to determine whether to continue using our services.
In the event of significant operational changes, Convertia reserves the right to take necessary measures to protect the security and safe operation of its platform, including temporarily suspending operations for the affected digital currency(ies) and other appropriate measures. We will make reasonable efforts to notify you of our response to any significant operational changes; however, such changes are beyond our control and may occur without notice to Convertia.
You acknowledge and accept the risks associated with operational changes to Digital Asset protocols and understand that Convertia is not responsible for such changes or any loss of value you may suffer as a result. You also acknowledge that Convertia has the sole discretion to determine its response to any operational changes and that we are under no obligation to assist you with incompatible coins or protocols.
By using our Services, you may access content or use services provided by third parties, including hyperlinks to third-party websites and services ("Third-Party Content"). We do not endorse, adopt, or control any Third-Party Content, and we assume no responsibility for such content. Any dealings or correspondence you have with these third parties are solely between you and the third parties.
We are not liable for any loss or damage of any kind incurred as a result of such dealings, and you understand that your use of Third-Party Content, as well as your interactions with third parties, are at your own risk.
To clarify, Convertia does not provide investment, tax, or legal advice. We also do not offer securities services or investment advice. All transactions through our Marketplace are conducted peer-to-peer between the Seller and the Buyer, and you are solely responsible for determining whether any investment, investment strategy, or related transaction is suitable for you, based on your personal investment objectives, financial circumstances, and risk tolerance.

In the event of a market disruption or Force Majeure event, we may take one or more of the following actions: (a) suspend access to the Services; or (b) prevent you from completing any action through the Services.
We will not be liable for losses suffered by you as a result of such actions. After any such event, when the Services are resumed, you acknowledge that prevailing market rates may differ significantly from the rates available before such an event.
We do not guarantee that the Website or the server that makes it available is free of viruses or errors, that its content is accurate, that it will be uninterrupted, or that defects will be corrected.
