By interacting with CONSULTORES REMALTEX, S.A.P.I. DE C.V. (hereinafter “Convertia”), you agree to be bound by our Terms and Conditions. If you do not agree with them, please refrain from using our website or services. By accessing our site, clicking accept, or using any Convertia Service, you consent to comply with our regulations, guidelines, and policies. If you are accepting these TERMS on behalf of an entity, you assure that you have the authority to bind such entity to Convertia’s TERMS and CONDITIONS.

This Agreement is established between you, hereinafter "the Customer," and Convertia, with an address at Av. Coyoacán #1878, Int. 1405-R, Col. Del Valle Centro, C.P. 03100, Benito Juárez, Mexico City, hereinafter "the Company."

TERMS OF USE

You must be 18 years or older to use Convertia.

Your use of this page must comply with these Terms and all applicable laws.

We reserve the right to suspend or terminate your access to Convertia’s services without prior notice if you reside in a country that prohibits our services or where we are prohibited from doing business.

You are responsible for knowing and complying with all applicable laws in your jurisdiction.

By using this page, you affirm that you know and agree to comply with your country’s laws and are not accessing the services from prohibited countries.

PRIVACY POLICY

Please refer to our Privacy Policy for detailed information on how we collect, use, and share your personal information. This policy is an integral part of our Terms and Conditions, and we recommend that you read it carefully.

UPDATES

We may update these terms at any time. We will notify members of changes through notices or emails before they become effective. Changes will generally be effective 15 days after their posting. Changes for legal reasons or new functionalities may become effective immediately.

You accept the amended Terms by continuing to use Convertia after the changes. If you do not agree, please cancel your account and stop using Convertia.

SERVICES

Convertia provides a practical and effective solution for exchanging digital assets for traditional currencies (such as US dollars or euros) and vice versa. The accessibility of our services may vary based on location and is subject to changes, substitutions, or suspensions at our discretion, with or without prior notice. Additionally, we offer a variety of services, including:

An exchange system that links your transactions with available offers.

Payment Immutability: Transactions are irreversible once executed.

Exchange Service: Buying and selling digital assets with Convertia.

Currency Wallet: Management of accounts with funds in specific currencies.

Digital Asset or Currency Purchase: Purchase of digital assets through designated payment methods.

Placing Purchase Orders: Efforts to meet applicable conversion rates.

Purchase Order Delays: Possible delays due to the availability of digital assets.

Fee Modification: Convertia reserves the right to adjust fees with prior notice.

VERIFICATION

Convertia operates as a custodian of the digital assets stored in the Convertia Wallet. These assets may be assigned upon account creation and will become the property of the user once the identity verification process is satisfactorily completed.

DIGITAL ASSET AND DIGITAL CURRENCY TRANSACTIONS

Convertia offers no guarantees about the value of digital assets or any other digital currency. It is important to note that these assets do not have the same status as legal tender and are not protected by institutions like the FDIC or SIPC.

Transactions with digital assets carry inherent financial risks due to their highly volatile nature. Market fluctuations can cause significant changes in the value of these assets in a short period. Transactions on the digital asset network are verified and confirmed by the network itself, and once performed, they cannot be confirmed, canceled, or reversed by Convertia. Therefore, it is essential that users understand and accept these risks before participating in any digital asset transaction.

Additionally, users should be aware of other potential risks, such as technical issues, cyberattacks, and regulatory changes, which could affect the security and value of their digital assets. Convertia strongly recommends that users adequately inform themselves and consider independent financial advice before participating in digital asset transactions.

THIRD-PARTY SERVICES

Customers have the opportunity to subscribe to Third-Party Services through Convertia, subject to additional fees and conditions set by the providers of such services.

WALLET ADDRESS AND PRIVATE KEY

Convertia uses a pair of cryptographic keys to secure transactions. The public key acts as the wallet address, while the private key is necessary to authorize transfers.

INTELLECTUAL PROPERTY RIGHTS

All rights to Convertia’s Materials, including copyrights, patents, trademarks, and other intellectual property rights, are retained by Convertia.

AUTHORIZED USE OF OUR SERVICES

You are required to use our Services only for authorized purposes, keeping your personal information updated. It is crucial to protect your account information and notify any unauthorized use or any security concerns.

MESSAGES

Provide a valid mobile phone number for authentication purposes and to use Convertia’s Services. By doing so, you agree to receive text/SMS messages with standard rates applied. It is important to provide accurate information and comply with registration requirements. Convertia reserves the right to deny access, open, suspend, or close accounts, based on compliance with governmental, regulatory, or identity verification requirements.

ILLEGAL ACTIVITIES

Illegal activities are strictly prohibited at Convertia. Users must not attempt unauthorized access, commit security violations, infringe laws, or carry out offensive acts on our Services.

PROHIBITED USERS

Users declare that they are not subject to sanctions or located in countries under U.S. economic sanctions. Convertia reserves the right to close access if users violate these representations.

TRADEMARKS

Convertia, along with its logo, are registered trademarks. Mention of other trademarks does not imply Convertia’s ownership of them.

DISCLAIMER OF WARRANTIES

The Services are provided "as is" without any warranty. Convertia disclaims all express or implied warranties and conditions.

ADVICE

Convertia does not provide financial, legal, or tax advice. Users are expected to understand the risks associated with transactions performed.

INDEMNIFICATION

By using the Services, users agree to indemnify Convertia against any claims, losses, or expenses arising from their use of the Services or violation of the established Terms.

LIABILITY

Convertia, its licensors, and service providers are not liable for indirect, special, or consequential damages. These liability limitations apply even if a limited remedy fails.

PROVISION

If any provision of these Terms is deemed invalid, the remaining provisions will remain in full force and effect.

CLAIM

Any claim related to access or use of the Services must be filed within two years.

UNCLAIMED ASSETS

After 30 days of inactivity, Convertia reserves the right to report or remit unclaimed digital assets or currency. The omission of enforcing any right or provision does not constitute a waiver of such right or provision.
